A lawyer for a South Dakota bar owner accused of serving a 12-year-old and two 14-year-olds alcohol and raping them has been recused from the case.
Third Circuit Judge Jon Erickson agreed to Jeff Burns' request to withdraw from representing 35-year-old Werner Fajardo. Authorities say Fajardo assaulted the three girls at the El Cuervo bar in Huron.
Burns says he has a conflict of interest because he recently learned he had previously represented a witness in the case. Erickson says a new lawyer will be appointed.
Fajardo has pleaded not guilty to six counts of rape and several counts of providing alcohol to minors. He is awaiting trial.
Police say Fajardo met the girls he's accused of raping through teen nights held at the bar.
