Charles Rhines Back In The Courtroom

Charles Russell Rhines has been on South Dakota’s death row since 1993 for the 1992 murder of Donnivan Shaeffer in a Rapid City donut shop.
Tuesday Rhines was back in the Rapid City courtroom, looking to have that death sentence tossed out.
Rhines' attorney is questioning the conduct of the prosecution during the trial and the constitutionality of the method of execution. But he says at the heart of the appeal is the failure of his client’s attorneys at the original trial and sentencing to properly investigate and present the mitigating factors in the case.
Judge Thomas Trimble set aside four days at the end of November for a court trial on the issue. If Rhines succeeds, another jury would sentence him again.
