Group Files Lawsuit Against Sioux Falls

A group trying to stop a Walmart from being built next to their neighborhood in Sioux Falls has filed a lawsuit against the city.
The group ‘Save Our Neighborhood,’ filed a petition against the City of Sioux Falls, and the city council. They held a press conference Wednesday to explain just what it means.
The group has been fighting the city to try and stop the Walmart from being built across from their residential neighborhood on 85th Street and Audie Avenue.
On April 2, the city council annexed the land into Sioux Falls, even though it was in Lincoln County. And according to the group, South Dakota State Law requires Sioux Falls to get permission from Lincoln County Commissioners before annexing the land. But the group said they haven’t.
“The City made a misstep when they didn't seek the Lincoln County Commission approval, and we brought that up to them numerous times, but they chose to proceed none the less,” said Dana Palmer, ‘Save Our Neighborhood.’
The group said they have been in contact with the Lincoln County Commission, but didn’t tell them about the lawsuit.
The group is also doing its own independent traffic study of the area. Walmart has already done its own and brought it to the city council for review. But residents said the council will benefit from seeing a second study.
KDLT contacted city council members who said they cannot comment on the lawsuit.
