Sturgis Council Changes Zoning Ordinance

City council members in Sturgis have changed the city's zoning ordinance in hopes of avoiding future lawsuits with any adult-oriented businesses that may want to locate in the Black Hills city.
Sturgis is defending itself in a lawsuit initiated by Dick & Jane's Naughty Spot, which contends the city should not have tried to force it to relocate.
Sturgis City Attorney Greg Barnier says leaving the ordinance as is leaves the city at risk for additional lawsuits from businesses claiming their constitutionally protected free-speech rights have been violated.
The new ordinance creates an overlay district within the city's general industrial zone where an adult-oriented business can get a conditional use permit away from churches or schools.
