An interview that James McVay did with a Wisconsin TV station
after being arrested for the murder of a Sioux Falls woman will be allowed as evidence.
In a motions hearing on Wednesday, Judge Peter Lieberman denied the defense’s motion to keep the TV interview out of the case. Lieberman said that the defense could not make a legal argument as to why the evidence should not be included.
In the TV interview, McVay admitted to killing 75-year-old Maybelle Schein as part of his plan to assassinate President Barack Obama.
In July of 2011, McVay pleaded guilty but mentally ill to first-degree murder.
KDLT's Rachel Skytta is in the courtroom and will have more tonight on KDLT News.
