McVay Still Facing Death Penalty

After the second day of James McVay's motion hearing, the death penalty remains a possible sentence.
Judge Peter Lieberman denied McVay's lawyers motion to preclude the death penalty as a sentencing option due to unequal funding.
After budget amounts and total expenditures from both the State's Attorney's Office and Public Defender's Office were presented, Judge Lieberman said the state will always have more resources such as law enforcement on both the local and state level. However he stated that he has not seen anything lacking on the defense side of the case whatsoever, and even if there was an issue of unequal funding, it would not be a basis to remove the death penalty as a sentencing option.
