SD Board Of Regents Remain Defendant In Lawsuit

A judge has denied a request from the South Dakota Board of Regents that it be removed from a lawsuit filed by the father of a boy who fell from a bunk bed at a 4-H youth camp.
Ted Header is suing the Regents, the Richmond Lake Youth Camp and Brown County for at least $28,000 to cover what he says are medical expenses resulting from his 11-year-old son's June 2011 fall from a bunk bed with no guard rail.
Brown County runs the youth camp. The state Board of Regents oversees South Dakota State University, which operates the state's 4-H program.
The Board of Regents argued it was a state entity that could not be sued, but Judge Jack Von Wald disagreed.
