A Minnehaha County judge has decided to allow admissions of texting while driving from the man accused of causing a fatal multi-car accident on Minnesota Avenue in July 2012.
Brent O'Neal, 22, is charged with 1st and 2nd degree manslaughter in the death of 33 year-old Philip Sorensen.
Defense lawyers argued during a motions hearing in July 2013 that statements made by O'Neal to visitors while he was in jail should be thrown out.
In those recorded conversations, O'Neal admits to multiple people that he was texting while driving when the accident happened.
O'Neal's trial date has not yet been set. He is currently free on bond.
