An investigation into the officer involved shooting of 22-year-old Jacob Westberg says that the officer was justified in firing his weapon.
The incident occurred on October 14 when a call to service to a Sioux Falls residence escalated to a standoff with law enforcement.
“It is the conclusion of this investigation and the Attorney General that the officer was justified in firing his weapon and using lethal force,” stated Attorney General Jackley.
Police say Westberg was suicidal, and was shot and killed after he pointed a rifle at officers outside a Sioux Falls home. Authorities say at least one gunshot was fired from the home, and that they unsuccessfully tried to negotiate with Westberg.
Westberg's parents say he was having problems with his ex-girlfriend and their young daughter, and needed someone to talk to. Brother Matt Westberg says he could have calmed Jacob down if he'd been given more time.
