Women To Marry, Challenge Gay Marriage Ban

Bookmark and Share

A lesbian couple from Rapid City plans to exchange vows Saturday in Minnesota then challenge South Dakota's ban on same-sex marriage and its refusal to recognize such nuptials.

The South Dakota Legislature banned gay marriage in 1996. State voters reiterated the prohibition in 2006 with a constitutional amendment that says only a marriage between a man and a woman is valid.

Minneapolis lawyer Joshua Newville represents 68-year-old Nancy Robrahn and 72-year-old Jennie Rosenkranz, who have been together for 27 years.

He says two other couples will join the case and also challenge a federal provision that allows states not to recognize same-sex marriages performed elsewhere.

Attorney General Marty Jackley says he's required by law to defend the constitution and state laws, which he will do if a lawsuit is filed.
