Talcum Powder Lawsuit Goes Forward for Sioux Falls Woman

A judge refused to dismiss a Sioux Falls woman's lawsuit claiming she developed ovarian cancer from
talc in talcum products sold by Johnson & Johnson.

Johnson & Johnson and a company that mines talc said Deane Berg's lawsuit against them should be dismissed because it was filed after a three-year statute of limitations expired.

U.S. District Judge Karen Schreier denied their motion on Tuesday and said the lawsuit met the filing requirement down to the final day.

The lawsuit says independent studies have shown an increased risk of ovarian cancer with the frequent use of talcum products in the genital area, and that the defendants failed to warn consumers about the risk.
