ABERDEEN, S.D. -

An attorney for an Aberdeen man convicted in the stabbing death of his ex-girlfriend says his client deserves a new trial.
    
A jury last month found 34-year-old John Hemminger guilty of premeditated murder in the January 2015 death of 26-year-old Jessica Goebel, of Aberdeen. Hemminger was sentenced to life in prison.
    
Defense attorneys believe prosecutor Chris White made an inappropriate statement when he told the jury that Hemminger's team could have presented more than 49 of the 500 text messages between the two as evidence.
    
Hemminger's attorneys say the comment shifted the burden of proof from the prosecution to the defense and they could not respond because it came during the final argument in the case.
    
Prosecutors have not filed their response.
