27-year-old Joseph Patterson is being charged with aggravated battery on an infant and aggravated assault.
He arrived at the Lincoln County Courthouse for his arraignment just before 11:30 this morning in handcuffs, with his head down.
Police say they were called to Patterson's apartment on South Connie Avenue in Sioux Falls around 5:45 Wednesday night on a report that a child was choking. They say the child was found unresponsive and was taken by ambulance to a local hospital.
Police say Patterson was the only person around the child at the time the incident occurred.
After investigating, police say it became clear that the boy's injuries were consistent with abuse and were not accidental.
According to court documents, Patterson intentionally or recklessly caused serious bodily injury to an infant causing intra-cranial or intra-ocular bleeding, or swelling of or damage to the brain. Documents say the injuries were caused by blows, shaking or causing the infants head to impact with an object or surface.
Patterson was arrested last night after being interviewed by Police.
Patterson did ask for a court appointed attorney and the judge assigned the Lincoln County Public Defender to his case.
One of the charges carries up to 25 years in prison. The second carries up to 15 years in prison.
Patterson is being held on a 750 thousand dollar cash only bond.
